Four important factors that define copyright in fashion

With the rise and democratization of access to information technologies, today it is easier to create fashion products without having a workshop or a fabric factory. Each country has legislation that protects the creators of fashion designs but, in many cases, copyright is violated.

Fashion design is not only the end result of a dress, pants or shirt. This also includes, for example, the sketches drawn at the beginning of the creation of the garment. Likewise, if we refer to a very unique and characteristic color, it could also be protected by legislation. A series of factors that are important in copyright in the fashion industry are detailed below.

  • The color. Nobody owns colors but they can be the mixture of some of them that generate new ones. The color range is increasingly wide thanks to the computer tools that display compositions and color models as popular as the so-called RGB and CMYK. There is no option to intellectually protect a color but to register it associated with the set of a logo or brand.
  • The sketches. A design, since it is created by someone on paper or on the computer screen, is protected by copyright. Copyright legally prevents it from being copied, displayed or distributed without the express authorization of its creator.
  • Cutting and sewing. The way to cut the pieces of a garment is not protected by copyright. Although you can certainly patent the way it is designed. It is certainly a complex legislation with many nuances.
  • The graphic design. As is known, the legislation of most countries protects designs on clothing. Normally brands patent and register their logos in addition to another series of elements that may be linked to the company’s branding. In this section we can also talk about textile design, which would address a whole series of components linked to clothing.
